Racial and Sexual Harassment in NASCAR

Wednesday June 11, 2008 @ 04:52 PM EDT

I read the article on the Home Page and figured that blogs about this incident will pop up right and left. Well, I read three so far but then the article just came out this morning. We all have the same information about this lawsuit, which is very little, but it appears some people have already made up their minds. Maybe the lawsuit will be thrown out of court or maybe the suit will be settled out of court. Who knows.

But let’s use some Common Sense here: A lot of the specific alleged accusations sound suspect to me. According to the accuser, the harassment started immediately after she became a Nascar employee and she has endured this alleged harassment for what 2 1/2 years. She claims to have brought this to the attention of her immediate supervisor but nothing was done about it. I don’t know about you, but I would have sought employment elsewhere if I was subjected to this type of treatment on a daily basis but yet she decided to stay. Supposedly, she never took these complaints any further than her immediate superior but 2 1/2 years later the light bulb goes off and she decided to sue Nascar for 225M. Hello, ring, ring, you don’t have to be a rocket scientist to see that something is fishy here.

Every major corporation, including Nascar, has a AA/EEO department that handles any kind of discrimination cases. Why didn’t she utilize Nascar’s AA/EEO? If I am being harassed and my supervisor is not taking me seriously and taking appropriate actions, I will take it to my company’s AA/EEO.

Every major corporation, including Nascar, has procedures in place whereby supervisors are required to document formal employee contacts, including periodic performance reviews. If she formally complaint to her supervisor about being harassed then dated documentation must exist. Having been a supervisor at AT&T with 19 very diverse employees, I documented every meeting with employees and took appropriate actions as required. Incidences of any kind of harassment were forwarded to AA/EEO for investigation. No supervisor in their right mind would ignore any allegations of harassment because of the potential consequences which could include termination of employment of the supervisor for not following company policy. So as a supervisor, you always have to CIA.

We see the Nascar Officials every weekend. I don’t know about you, but I see a lot of non-white and female officials. You look at the teams and see a lot of non-white pit crew members.

Could this lawsuit be just a tool to get back at Nascar for not giving in to a shake down? It is a known documented fact that major corporations have gone thru the shake-down lead by Jessie Jackson et al. I have read a newspaper article a couple of years ago that listed all the companies that were approached by the aforementioned and the amount of contributions made to Jessie Jackson’s organizations. I was shocked and disappointed that my company, AT&T, was on that list as well. Even Anheuser Busch gave in to the pressure and Jessie Jackson’s son ended up with a Anheuser Busch distributor ship. At the time I wondered: what does he know about making and distributing beer?

Well, I for one will not be surprised to see Al Sharpton march and demonstrate at Nascar headquartes in support of this lawsuit.

Let me just make one thing clear. I am not saying this person is lying. I am in no position to do that. All I am saying is the story sounds suspect. If there is truth to this matter, then I will trust that Nascar will take the appropriate actions, including but not limited to dismissing certain supervisors for not doing their jobs and implement additional training for all of their management personel.

Nascar’s Diversity Program is alive and thriving and it really would be a shame if this incident would create a black mark on Nascar.
