NASCAR.COM Commnuity Standards

    The NASCAR.COM Community is a part of NASCAR.COM that is a social networking platform for NASCAR.COM users. It is offered by Turner Sports Interactive, Inc. on behalf of the National Association for Stock Car Auto Racing, Inc. and includes the NASCAR.COM Community web pages and any other features, content, applications, services and/or functionality offered by TSI from time to time in connection with the NASCAR.COM Community (collectively, “NASCAR.COM Community"). As used in this document, “TSI” refers to Turner Sports Interactive, Inc. and its respective parents, subsidiaries and affiliates, and the employees, officers, directors and agents of the foregoing. As used in this document, “NASCAR” refers to the National Association for Stock Car Auto Racing, Inc. and its respective parents, subsidiaries and affiliates, and the employees, officers, directors and agents of the foregoing. These NASCAR.COM Community Standards (“Standards”) set forth certain standards of conduct and other terms applicable to your use of the NASCAR.COM Community. Use of the NASCAR.COM Community is also subject to the NASCAR.COM Service Agreement, available at http://www.nascar.com/guides/terms/. In addition, you agree that any information collected in connection with your use of the NASCAR.COM Community is subject to the NASCAR.COM Privacy Policy, which can be located at http://www.nascar.com/guides/about/privacy.html, and that TSI and NASCAR may use such information consistent with the NASCAR.COM Privacy Policy. By using the NASCAR.COM Community, you agree to the terms and conditions of these Standards, the NASCAR.COM Service Agreement and the NASCAR.COM Privacy Policy. If you do not agree to the aforementioned documents, you may not use the NASCAR.COM Community and must discontinue such use immediately. To the extent that there is a conflict between the terms of these Standards and the terms of the NASCAR.COM Service Agreement, the terms of these Standards shall control.

    TSI and NASCAR shall have the right at any time to change or discontinue any and/or all aspects or features of the NASCAR.COM Community, including, but not limited to, content, hours of availability, and equipment needed for access or use.

    MEMBERS, VISITORS AND USERS. As used in these Standards, (i) "Visitor" means a NASCAR.COM Community user that accesses the NASCAR.COM Community web pages without registering and/or logging-in, (ii) "Member" means a NASCAR.COM Community user that has registered with the NASCAR.COM Community, and (iii) “User” means and includes both Members and Visitors.

    ADDITIONAL TERMS. In order to use certain NASCAR.COM Community offerings, you may be required to download software or content and/or agree to additional terms and conditions governing your use. Unless otherwise provided by the additional terms and conditions applicable to the particular offerings that you choose to use, any such additional terms are hereby incorporated into these Standards.

    MODIFICATIONS TO THESE STANDARDS. These Standards may be modified from time to time and such modification shall be effective upon posting by TSI and/or NASCAR within the NASCAR.COM Community web pages. By using the NASCAR.COM Community after any such modification is posted, you agree to be bound by the modified Standards. It is therefore important that you review these Standards regularly to ensure you are updated as to any modifications.

    AGE REQUIREMENTS; REGISTRATION INFORMATION. By using the NASCAR.COM Community, you represent and warrant that (i) all registration information you submit is truthful and accurate; (ii) you will maintain the accuracy of such information; (iii) you are 13 years of age or older; and (d) your use of the NASCAR.COM Community does not violate any applicable law or regulation. You may not use the NASCAR.COM Community if you are not at least 13 years of age.

    PASSWORD. During the Member registration process, each potential Member must choose a username and password for the potential Member’s NASCAR.COM Community account. You are responsible for maintaining the confidentiality of your username and password. You agree that you shall not use the account, username or password of another Member at any time and you shall not disclose your password to any third party. You agree to notify TSI immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account and/or password.

    YOUR USE MUST BE NON-COMMERCIAL. You may only use the NASCAR.COM Community for your individual, non-commercial purposes and you may not use the NASCAR.COM Community in connection with any commercial endeavors, except those (if any) that are specifically authorized by TSI (in its sole discretion) in advance in a separate written agreement signed by an authorized representative of TSI. Illegal and/or unauthorized use of the NASCAR.COM Community, including, without limitation, your collection of usernames and/or email addresses of Members by electronic or other means for the purpose of sending unsolicited email, or unauthorized framing of or linking to the NASCAR.COM Community web pages, is prohibited. User-posted advertisements, affiliate links and other User-generated commercial materials, and other forms of User-initiated solicitation, are prohibited within the NASCAR.COM Community and may result in termination of Membership privileges.

    SUBMISSIONS. By submitting Materials (defined as follows) to and/or via the NASCAR.COM Community, and in exchange for good and valuable consideration, the sufficiency and receipt of which you hereby acknowledge, you hereby grant to TSI and NASCAR a non-exclusive, perpetual, royalty-free, fully-paid, worldwide license to edit, telecast, rerun, reproduce, use, create derivative works from, modify, syndicate, license, print, sublicense, distribute and otherwise exhibit the Materials you submit, or any portion thereof, in any manner and in any medium or forum, whether now known or hereafter devised. For the purposes of these Standards, “Materials” means and includes all data, information, images, video, audio, pictures, sounds, files and/or any other content, materials and/or intellectual property.

    Please choose carefully the Materials you submit to the NASCAR.COM Community and/or that you provide to other Users. Your submissions are non-confidential and the NASCAR.COM Parties have no obligation to maintain the confidentiality of any information, in whatever form, contained in any submission, except pursuant to the NASCAR.COM Privacy Policy, available at http://www.nascar.com/guides/about/privacy.html. Information and content you post to the public areas of the NASCAR.COM Community may be viewed by other Users, so please do not post information and/or content that you do not wish other Users to have access to.

    By submitting Material to the NASCAR.COM Community, you warrant that the owner(s) of such Materials and of the intellectual property rights in such Materials has/have expressly granted you the right to submit such Materials to the NASCAR.COM Community for use by you, NASCAR and TSI and described in these Standards.

    You further represent and warrant to TSI and NASCAR that: (i) you have the full legal right, power and authority to grant to TSI and NASCAR the license provided for in these Standards; (ii) you own or control the complete exhibition and other rights to any Materials you submit; (iii) neither the Materials you submit nor the exercise of the rights granted herein shall infringe upon or violate any rights of any third party, including, but not limited to, any intellectual property rights and/or any rights of privacy or publicity; and (iv) neither the Materials you submit nor the exercise of the rights granted herein shall defame any other person or entity. You agree to pay for all royalties, fees, and any other monies owing any person or entity by reason of any Materials posted by you to or through the NASCAR.COM Community.

    Any opinions, views, advice, statements, services, offers or other information or content expressed or made available by you or any third parties (e.g., other Users, professional information providers, etc.) are those of the respective author(s) or submitter(s) and not of TSI or NASCAR. Neither TSI nor NASCAR guarantees the accuracy, completeness, or usefulness of any content, nor its merchantability or fitness for any particular purpose. Users are solely responsible for anything contained in their submissions, message board and/or chat sessions. NASCAR and TSI do not verify, endorse or otherwise vouch for the contents of any submission, message board or chat room. Users may be held legally liable for the contents of their submissions, message board and chat sessions, and may be held legally liable if their submissions or chat sessions include, for example, material protected by copyright, trademark, patent or trade secret law or other proprietary right without permission of the author or owner, or defamatory comments. TSI and NASCAR reserve the right, in their sole discretion, to reject, to refuse to post and/or to remove any posting (including private messages) by you, for any or no reason, with or without prior notice, and without liability on the part of TSI or NASCAR.

    TSI and NASCAR do not accept or consider business and/or programming proposals and/or similar suggestions and/or materials (“Proposals”) other than those they have specifically requested. This is to avoid the possibility of future misunderstandings when projects independently developed by TSI or NASCAR might seem to others to be similar to their own proposals or suggestions. If you do send or post any Proposals, including related ideas, notes, drawings, concepts or other information, or if you transmit them through the NASCAR.COM Community by electronic mail or otherwise, the Proposals shall be deemed, and shall remain, the property of TSI. None of the Proposals shall be subject to any obligation on the part of TSI and/or NASCAR to use the Proposals or keep them confidential and neither TSI nor NASCAR shall be liable for any use or disclosure of any Proposals. TSI shall exclusively own any now known or hereafter existing rights to the Proposals of every kind and nature throughout the universe and shall be entitled to unrestricted use of the Proposals for any purpose whatsoever, commercial or otherwise, without compensation to the provider of the Proposals.

    INTELLECTUAL PROPERTY RIGHTS OF NASCAR AND TSI. The NASCAR.COM Community contains copyrighted Material, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound. Turner and NASCAR own a copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to them. You may View web pages of the NASCAR.COM Community for your personal use only and only as permitted by these standards and any other rules posted by TSI within the NASCAR.COM Community from time to time. Except as otherwise expressly permitted under applicable law, no copying, redistribution, retransmission, licensing, publication, commercial exploitation or other use of any Materials available at the NASCAR.COM Community is authorized without the express, advance written permission of TSI, NASCAR and the copyright owner, and the owner of any other legal interests in the applicable Materials. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademarks legend or copyright notice shall be made. You acknowledge that you do not acquire any ownership rights by viewing copyrighted material. For further information on U.S. copyright law, you may wish to visit the web site of the U.S. Copyright Office at: http://lcweb.loc.gov/copyright/. NASCAR and TSI expressly reserve all ownership and other rights (including, but not limited to, intellectual property rights) in their respective Materials and no such rights are transferred to you.

    CONTENT AND ACTIVITY STANDARDS. You agree not to post, transmit and/or conduct through the NASCAR.COM Community any Materials and/or activities that:

    1. Are offensive and/or promote racism, bigotry, hatred or physical harm of any kind against any group or individual;
    2. Harass or advocate harassment of another person;
    3. Exploit people in a sexual or violent manner or depict violent or sexual imagery;
    4. Contain nudity, pornography, violence, or offensive subject matter or contain any link to an adult website;
    5. Contain profanity or masked profanity;
    6. Infringe upon or violate any third party’s rights (including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person’s name, e-mail address, physical address or phone number) or rights of publicity;
    7. Provide any telephone numbers, street addresses, URLs or email addresses (except such information of yours as necessary for you to register to become a Member);
    8. Promote information that you know is false or misleading or promote illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
    9. Promote an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music, video or links to pirated music or video files;
    10. Involve the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spimming," or "spamming";
    11. Contain restricted or password only access pages or hidden pages or images (i.e., those not linked to or from another accessible page);
    12. Further or promote any criminal or tortious activity or enterprise or provide instructional information about illegal activities including, but not limited to, making or buying illegal weapons, violating an individual’s privacy, or providing or creating computer viruses;
    13. Contain viruses, time bombs, Trojan horses, cancelbots, worms or other harmful, or disruptive creations, components or devices;
    14. Try to gain unauthorized access to the NASCAR.COM Community, profiles, blogs, chat rooms, communities, account information, bulletins, or other aspects of the NASCAR.COM Community or solicit passwords or personal identifying information from other users;
    15. Involve commercial activities and/or sales without TSI’s prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes;
    16. Include a photograph, image, video, intellectual property or other property of another person or entity that you have posted without that person's or entity’s consent (or in the case of a minor, the minor’s legal guardian);
    17. Advertise or solicit any User to buy or sell any products or services through the NASCAR.COM Community;
    18. Attempt to obtain information from the NASCAR.COM Community in order to contact, advertise to, solicit, or sell to any User;
    19. Cover or obscure the banner or other advertisements placed by TSI or its advertisers on your personal profile page or any other NASCAR.COM Community page (e.g., via HTML/CSS or any other means);
    20. Conduct any automated use of the system, such as using scripts to add friends or send comments or messages;
    21. Interfere with, disrupt or create an undue burden on the NASCAR.COM Community or the networks or services connected to the NASCAR.COM Community;
    22. Attempt to impersonate another User or person or entity;
    23. Use the account, username or password of another Member at any time or disclose your password to any third party or permit any third party to access your account;
    24. Sell or otherwise transfer your profile;
    25. Use any information obtained from the NASCAR.COM Community in order to harass, abuse, or harm another person;
    26. Place any advertisement on your profile, or accept payment or anything of value from a third person in exchange for your performing any commercial activity on or through the NASCAR.COM Community on behalf of that person, such as placing commercial content on your profile, posting blogs or bulletins with a commercial purpose, selecting a profile with a commercial purpose as one of your friends, or sending private messages with a commercial purpose;
    27. Interfere with another user’s use and enjoyment of the NASCAR.COM Community, or any other individual’s use and enjoyment of similar services;
    28. Refer to any website or URL or other content that, in the sole discretion of TSI, contains material that is inappropriate for the NASCAR.COM Community, contains content that would be prohibited within the NASCAR.COM Community or violates the letter or spirit of these Standards; or
    29. Use the NASCAR.COM Community in a manner inconsistent with any applicable laws and/or regulations.

    NO SPAM. TSI and NASCAR reserve the right to restrict the number of emails and/or other messages which a Member may send to other Members in any twenty-four hour period via the NASCAR.COM Community. If you breach these Standards and send unsolicited bulk email, instant messages or other unsolicited communications of any kind through the NASCAR.COM Community, you acknowledge that you will have caused substantial harm to TSI and NASCAR, but that the amount of such harm would be extremely difficult to ascertain. As a reasonable estimation of such harm, you agree to pay TSI fifty dollars ($50) for each such unsolicited email or other unsolicited communication you send through the NASCAR.COM Community.

    COMPLIANCE WITH THE DIGITAL MILLENNIUM COPYRIGHT ACT OF 1998 ("DMCA"). TSI and NASCAR respect the rights of all copyright holders and in this regard, TSI and NASCAR have adopted and implemented a policy for the NASCAR.COM Community that provides for the removal and/or blocking of allegedly infringing material upon receipt of properly filed complaints satisfying the requirements of the DMCA, as well as for the termination in appropriate circumstances of subscribers and account holders who infringe the rights of copyright holders.

    2. YOUR NOTICE SHOULD INCLUDE THE FOLLOWING:
      1. A physical or electronic signature of a person authorized to act on behalf of the person or entity that owns an exclusive copyright right that is allegedly infringed;
      2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by the notification, a representative list of such works allegedly at the NASCAR.COM Community;
      3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit TSI to locate the material;
      4. Information reasonably sufficient to permit TSI to contact the complaining party;
      5. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
      6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

    MONITORING. TSI and NASCAR shall have the right, but not the obligation, to monitor the content of the NASCAR.COM Community, including online forums, to determine compliance with these Standards and the NASCAR.COM Service Agreement. TSI and NASCAR reserve the right, in their sole discretion, to reject, to refuse to post and/or to remove any Materials posted by you (including private messages), for any or no reason, with or without prior notice, and without liability on the part of TSI or NASCAR. The decision by TSI and/or NASCAR to monitor and/or modify the content and/or functions of the NASCAR.COM Community does not constitute nor shall it be deemed to constitute any responsibility or liability in any manner on the part of TSI and/or NASCAR in connection with or arising from use by you of the NASCAR.COM Community or participation in any online forums or interactive features of the NASCAR.COM Community.

    RISK OF USE OF THE NASCAR.COM COMMUNITY. In no event shall you represent or suggest, directly or indirectly, that NASCAR, TSI and/or the NASCAR.COM Community endorse any User submissions. The NASCAR.COM Community, NASCAR and TSI do not vouch for the accuracy or credibility of any Materials submitted by Users on the NASCAR.COM Community web pages, and do not take any responsibility or assume any liability for any actions you may take as a result of reading User-published content on the NASCAR.COM Community. Through your use of the NASCAR.Com Community, you may be exposed to content that you may find offensive, objectionable, harmful, inaccurate or deceptive. There may also be risks of dealing with underage persons, people acting under false pretense, international trade issues and foreign nationals. By using the NASCAR.Com Community, you assume all associated risks. Without limiting the generality of the foregoing: (i) Subject to the NASCAR.COM Privacy Policy, you understand and agree that NASCAR.COM has the right at all times to disclose the identity of the persons providing information or materials on the NASCAR.COM Community, and that this may include, without limitation, disclosure of the information in connection with investigation of alleged illegal activity or solicitation of illegal activity or in response to a lawful court order or subpoena; and (ii) You agree that (A) your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the NASCAR.COM Community, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser, and (B) neither TSI nor NASCAR shall be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers within the NASCAR.COM Community.

    CREW CHIEF AND MEMBER DESIGNATIONS. Designation as a NASCAR.COM Community Crew Chief or Member shall not be deemed to create any official affiliation, partnership, joint venture, employment or other similar arrangement with NASCAR.COM, TSI and/or NASCAR, and you shall not state or imply the existence of any such arrangement.

    DISCLAIMER OF WARRANTY; LIMITATION OF LIABILITY. You expressly agree that use of the NASCAR.COM Community is at your sole risk. Neither TSI nor NASCAR warrant that the NASCAR.COM Community will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of the NASCAR.COM Community, or as to the accuracy, reliability or content of any information, service, or merchandise provided through the NASCAR.COM Community. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE NASCAR.COM COMMUNITY IS PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

    THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION,COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT, DESTRUCTION OR UNAUTHORIZED ACCESS OR USE, WHETHER SOUGHT FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OR THEORY OF ACTION. YOU SPECIFICALLY ACKNOWLEDGE THAT TSI AND NASCAR ARE NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OF THE NASCAR.COM COMMUNITY OR OTHER THIRD PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH YOU. IN NO EVENT WILL TSI OR NASCAR, OR ANY PERSON OR ENTITY ENGAGED BY TSI OR NASCAR IN CONNECTION WITH CREATING, PRODUCING OR DISTRIBUTING THE NASCAR.COM COMMUNITY, BE LIABLE FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE NASCAR.COM COMMUNITY, NOR SHALL TSI OR NASCAR, OR ANY PERSON OR ENTITY ENGAGED BY TSI OR NASCAR IN CONNECTION WITH CREATING, PRODUCING OR DISTRIBUTING THE NASCAR.COM COMMUNITY, BE LIABLE FOR ANY DAMAGES, CLAIMS, OR INJURY, INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR PERSONAL OR BODILY INJURY, ARISING FROM OR IN CONNECTION WITH YOUR CREATING CONTENT, WHETHER BY VIDEOTAPING, PHOTOGRAPHY OR OTHERWISE, FOR SUBMISSION TO THE NASCAR.COM COMMUNITY, AND YOU HEREBY ASSUME ALL RISK FOR ANY DAMAGES, CLAIMS OR INJURIES. WITHOUT LIMITING THE FOREGOING, NEITHER NASCAR NOR TSI SHALL BE LIABLE REGARDLESS OF THE CAUSE OR DURATION, FOR ANY ERRORS, INACCURACIES, OMISSIONS, OR OTHER DEFECTS IN, OR UNTIMELINESS OR INAUTHENTICITY OF, THE INFORMATION CONTAINED WITHIN THE NASCAR.COM COMMUNITY, OR FOR ANY DELAY OR INTERRUPTION IN THE TRANSMISSION THEREOF TO THE USER, OR FOR ANY CLAIMS OR LOSSES ARISING THEREFROM OR OCCASIONED THEREBY. NEITHER TSI NOR NASCAR SHALL BE LIABLE FOR ANY THIRD-PARTY CLAIMS OR LOSSES OF ANY NATURE INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, PUNITIVE OR CONSEQUENTIAL DAMAGES.

    The operators of the NASCAR.COM Community make reasonable efforts to protect personally identifiable information about you, as explained in the NASCAR.COM Privacy Policy, available at http://www.nascar.com/guides/privacy/. However, it is possible that third parties (including unauthorized users, or, “hackers”) may obtain personal information about you due to your use of the NASCAR.COM Community, and that the recipient may use such information to harass or injure you. TSI and NASCAR do not approve of such unauthorized use of your information, but (to the maximum extent permitted by applicable law) TSI and NASCAR disclaim any and all liability of any kind for any unauthorized access to or use of your personally identifiable information. By accessing the NASCAR.COM Community, and to the maximum extent permitted by applicable law, you acknowledge and agree to this disclaimer of any such liability. If you do not agree, you should not access or use the NASCAR.COM Community.

    TERMINATION. You agree that TSI and/or NASCAR, in their sole discretion and without liability on their part, may terminate your account, password, and username and/or use of the NASCAR.COM Community, and may remove and discard any content and/or other Materials within the NASCAR.COM Community, for any reason, including, without limitation, if TSI and/or NASCAR believes that you have violated or acted inconsistently with the letter or spirit of these Standards. You agree that any termination of your access to the NASCAR.COM Community may be effected without prior notice, and acknowledge and agree that TSI and/or NASCAR may immediately deactivate or delete your account, password and username and all related information and files associated with it and/or bar any further access to such files or the NASCAR.COM Community. Further, you agree that TSI and/or NASCAR shall not be liable to you or any third-party for any termination of your access to the NASCAR.COM Community and/or for any deletion and/or removal of any Materials submitted by you. Appropriate legal action may be taken by TSI and/or NASCAR in response to any illegal and/or unauthorized use of the NASCAR.COM Community.

    INDEMNIFICATION. You agree to defend, indemnify and hold harmless TSI and NASCAR from and against all claims and expenses, including attorneys' fees, arising out of the use of the NASCAR.COM Community by you or through your account (regardless of whether the use through your account is conducted by you or any other person). TSI reserves the right to take over the exclusive defense of any claim for which it and/or NASCAR is entitled to indemnification under this paragraph. In such event, you shall provide TSI with such cooperation as is reasonably requested by TSI.

    TRADEMARKS. "NASCAR.COM" and the NASCAR.COM logo are trademarks of NASCAR. All rights reserved. All other trademarks, logos and service marks appearing on the NASCAR.COM Community are the property of TSI and/or NASCAR or their respective owners.

    MISCELLANEOUS. These Standards, the NASCAR.COM Service Agreement, available at http://www.nascar.com/guides/terms/, the NASCAR.COM Privacy Policy, available at http://www.nascar.com/guides/about/privacy.html, any operating rules for the NASCAR.COM Community established by TSI, and any additional terms provided by TSI per the paragraph above titled “Additional Terms”, constitute the entire agreement of the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to the subject matter hereof. These Standards shall be construed in accordance with the laws of the State of Georgia, without regard to its conflict of laws rules. If you access the NASCAR.COM Community from any location other than the United States, you accept full responsibility for compliance with all local laws. You are also subject to United States export controls and are responsible for any violations of United States embargoes or other federal rules and regulations restricting exports. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. If any part of these Standards is found by a court of competent jurisdiction to be invalid or unenforceable, it will be replaced with language reflecting the original purpose in a valid and enforceable manner. The enforceable sections of these Standards will remain binding upon the parties.
